Legal assistance in case of breach of contract
Questioner
I am an arranger, composer. Let's say A A number of titles are published by, let's say, publisher B. The connection has been going on for 28 years. B. has still not opened his own website in that time. So I think he is at fault. It is true that orders for these publications largely go through A (my own website), for which I receive an additional percentage, but the fact remains that he is in default and is unable to complete the PR in the normal way. In the meantime I have switched to selling it myself through my own site. But B thinks that's criminal. You understand that I want to end the contract. How do you rate my chances? Thanks in advanceLawyer
Whether your desired termination of the contract can succeed depends on what you have agreed with B regarding his promotional obligations. If you have agreed that he has an online website on which the titles are delivered, then he is in breach if he does not do this and you can put him in default in this respect and summon him to fulfil his obligation. If he still does not fulfil his obligation, then you can terminate the contract.Take the next step
