Installing a dormer window? VvE information and advice
Questioner
I am the owner of a condominium in a small homeowners' association (6 owners in total). I might want to install a dormer window, but do I need permission from the homeowners' association for this? Does the deed of division also need to be adjusted after this, because my home has become larger, and therefore the distribution key has changed?Lawyer
You must realize that in a VvE all members jointly own the entire building; you only have an exclusive right of use for your apartment. As a result, all changes to the building must always be approved by the meeting of the VvE. In particular, changes to the outer shell always require the approval of the VvE; even if something changes to a part of the building that is intended for common use. For example, the roof is a part of the building that is intended for common use and the change you want may restrict others in their right to use the roof. Whether the deed of division needs to be changed depends on whether the drawings of the separated apartment rights are changed and whether a part of what was previously common becomes exclusive to you. Whether the distribution key changes also depends on the circumstances; if the surface area of your unit of use does not change, that could be a circumstance not to change the distribution key.Take the next step
