Legal assistance with logo copyright

Questioner

The creator of my logo (design made based on my wishes regarding shape, colors and size and for which I also paid) has an image of that logo on his Facebook as a portfolio. I never gave permission for that and he refuses to remove the image. Is this correct and/or what can I do?

Lawyer

You may have given prior permission in the terms and conditions for self-promotion of material you have created; if not, you can order him to stop the disclosure.

Lawyer

Unless otherwise agreed, the copyright on the logo rests with the designer. He can therefore use the logo however he wants. You will have to check what has been agreed in this regard in the assignment agreement or in the general terms and conditions of the designer, if applicable.
