Legal Advice on Webshop Problems
Questioner
I ordered a GPS from an online store in Germany (11/8). Article received (16/8) I have informed the company that I want to use my right of withdrawal (22/8). I have returned this item unused and undamaged in original packaging by registered mail (24/8) The article has demonstrably arrived via the PostNL site (27/8) In addition, the webshop has promised to refund the amount twice by email, but you guessed it, nothing has been received to this day (2/11). The webshop cannot be reached by telephone and further (polite) emails from my side are no longer responded to. I now want to send a registered reminder in which I indicate that if the amount is not transferred within 8 days I will take further steps. I just don't know whether such a reminder is wise and what steps I should take.Lawyer
You should not send a reminder, but a notice of default with a recovery period of 5 days. After that, your claim is due. If desired, I can assist you with this if you contact me directly or ask a follow-up question.Lawyer
A reminder puts the debtor in default. If 30 days have passed since they promised to pay back the money, they are already in default. So you can hire a (German) lawyer and they must also reimburse the costs. I think they will not respond otherwise.Take the next step
