Legal assistance with child support
Questioner
I am a divorced woman with two children aged 9 and 11. My ex has a very good job and child support was determined on that basis. He also pays a portion of spousal support. Early September he quit his job and now has no paid job. His new wife had a great job in care, but quit that too. They got married in December 2017, before the change in the law of “in community of property”. My question is: Can my ex-wife get the court to pay less or no child support? Given the stories my children are pestering me with, I have the strong impression that this is a deliberate attempt to get rid of the alimony. After all, he must provide full disclosure to the lawyer/judge about his income, which is €0.00 for his wife and only 2/3 of his annual salary. Coldly referring to the numbers, he could argue… I no longer have the means to pay…Lawyer
In this case, your ex will have to be shown his earning capacity. He can earn such an income but has apparently chosen to quit his job. Under these circumstances, it is only reasonable to expect him to continue paying the previously imposed alimony.Take the next step
