Legal Advice on Sickness Benefits Act and Dismissal | Legal Advice Centre

Questioner

Dear Sir/Madam I am currently on sick leave for a few weeks. Since this week I am going to start working at work again for a few hours and I am slowly building this up. Now last week I found THE job that I really want. If I am accepted, are there any consequences for resigning from my current job? This because I am still on sick leave? And, am I obliged to inform my potential new employer that I am currently on sick leave? I'd like to hear it

Lawyer

If you are still ill or remain incapacitated for work for a while, it is unwise to resign. The current employer would then require you to report yourself better. If you resign anyway, you are committing a detrimental act towards the UWV in the event that you become ill again. You are not obliged to report that you are on sick leave to your new employer, but from a moral point of view it is advisable. You may also get into trouble if it turns out that you have concealed certain things. If a dispute arises, you can contact me directly if you wish.
