Contract not renewed? Discover your rights
Questioner
I was informed last Wednesday that my contract would not be extended. I later found out that the day before my contract expired they told me that they were not going to renew my contract. The sales assistant called the HR department but they said that it was legally allowed. Hoping you can help me Yours sincerely,Lawyer
A fixed-term employment contract ends by operation of law. This means that it ends after the agreed period has elapsed. Termination is not necessary. For a contract longer than 6 months, at least 1 month's notice must be given. This must be in writing. If the employer fails to do so, he will owe a fine. This is a maximum of 1 month's salary.Lawyer
If the fine my colleague mentions is not paid by your (former) employer, you have up to two months after the end of the employment contract to claim it via the subdistrict court. After that, that right has expired. Incidentally, employers sometimes already state in the fixed-term employment contract itself that it will not be extended. In that case, the notification obligation has already been met immediately and you cannot claim a fine.Take the next step
