0-hour contract: Frequently asked questions and advice

Hello, I have a question regarding a 0-hour contract. I have been working at a WG since September 2017 and would receive a 0-hour contract for this. The compensation I receive is 12.50 p/hour. The hours worked are always paid properly on the 1st of the following month. Only now am I offered this 0-hour contract. In the contract offered to me, Article 10 states: The salary is paid at the end of the month based on actual hours worked per month and amounts to € 12.50 net per hour incl. holiday allowance when entering into this agreement. In case of illness, no salary is paid. My questions: 1. Is the WG required for deductions etc. in the case of a 0-hour contract, so that taxes etc. are also withheld from my salary? 1.a In case of illness, no salary is paid, that is no longer allowed, right? 2. And is WG obliged to provide me with a pay slip? 3. I work 1 day of 3.75 hours, the WG obliges me to take a 15 minute unpaid coffee break, is that allowed? 4. On Thursday I work 2 hours in the evening, shouldn't he pay for 3 hours? I look forward to receiving your reply.

Even with a 0-hour contract, wage tax and premiums will have to be paid on worked and paid hours. You may agree on a net wage, but that must then be grossed up. If you were to become ill, you are in principle entitled to continued payment of wages calculated on the average number of hours you worked over a period of 3 months. However, 2 waiting days may be applied, but this must be explicitly agreed. You are entitled to a pay slip.
