In our VvE someone wants to place a folding screen on the balcony balustrade to close off the balcony. The building inspector gives his approval. I want to draw up a contract if, for example, a gust of wind damages the screen on the balcony balustrade or the underside of the balcony above, that the person is liable for the damage incurred. The VvE is responsible for the balconies and facades. How do I draw up such a liability contract?Lawyer
Most division regulations state that it is not permitted to make changes to the common areas and property of the building without the permission of the meeting. The balcony balustrade is probably common, so it is preferable to submit the installation of a folding screen to the meeting of the VvE for approval. The more recent model division regulations further stipulate that the owner is liable for any damage caused by him to the common areas and/or property. He is also legally liable for any damage caused to the private area or property of others. In order to prevent discussions in the future about who is liable for the folding screen and the damage caused by it, it is advisable to stipulate in an agreement that the owner is responsible for the folding screen and is liable for all damage caused by the screen to the common area/property or private areas/property.
