Legal Assistance Parking Permit Amsterdam

Questioner

I will not receive a parking permit for an indefinite period from the municipality of Amsterdam. They indicate that I have my own parking facility. The piece of land in front of my house is paved. Neighbors who also have such a piece of land but have arranged it as a garden will receive a parking permit for an indefinite period. here is added that in my opinion the piece of land in front of my house is too small. the total length is 5 meters. I also use this as (only) free passage to my house. so there is insufficient remaining space for a parking space. I am going to file an objection and would like help in determining the right arguments. I have already made a draft objection.

Lawyer

Interesting, has a driveway permit been issued on site? The Amsterdam parking regulations are broad in their interpretation: parking space: a place, legally, factually or in terms of planning, designated or intended for parking motor vehicles, located outside the public road and not open to or accessible to public traffic and In assessing whether a resident has or can have a parking space and/or an interested party parking space, a broad interpretation is assumed on the basis of case law. 'Can have' is therefore also understood to mean that the applicant can buy or rent a parking space in the garage that belongs to the block (part) where he is located. This does not concern the question of whether one is financially able to buy or rent a parking space, but the question of whether a parking space is for sale or rent. In a permit area in which parking is organised indoors and no parking permits are issued, subsequent buyers or tenants of first buyers or tenants without a parking space are deemed to be aware of the fact that there is no entitlement to a parking permit for that address. If a resident does not use or has not realised a parking space as such, this is at the risk of the resident. This could be the situation in which a home has or should have a garage or a parking space, but that this is used for other purposes. Did the previous tenant or buyer say anything about this? If it was a seller, there may still be possibilities for recovery.
