Odour nuisance from neighbours: your rights and solutions
Questioner
Hello, we experience a lot of stench nuisance from our neighbors. When they cook and there is a bit of wind outside, the strong food smell is blown into our house. We have already taken many measures, but unfortunately without good results. The food smell comes from a pipe on the roof at the height of our dormer window. The pipe is practically on the border between their house and ours. Since we are currently unable to figure it out, the question is; is this allowed? 'Discharging' your dirty smell right next to us and causing considerable nuisance? We are curious about what this means legally. I have not yet found an answer with the information about building regulations. Thanks in advance and kind regards.Lawyer
If you rent the property, you can file a complaint with your landlord to solve the problem. You have the right to enjoy the rental property and the landlord will have to tackle this problem. If you own a home, you can ask the municipality for enforcement. Report this to the municipality in writing. If you are unable to reach an agreement (yet), I would be happy to look at your case.Take the next step
