Questioner

Halo, Executor of testamentary / settlement administrator has (finally) put the house up for sale after a year and a half of the deceased's death. The house was sold within a week. This was already 3 weeks ago. The money is in his account. Is there a deadline within which he must pay the money to the heirs, including my husband. Thank you.

Lawyer

This payment must be made within 4 weeks after the sale has been made public to the heirs. It is also possible that there are 'objections' from creditors etc. If you have any questions, please ask.

Questioner

Thank you very much for your response. Do you perhaps have a site or linq for me where I can find this?

Lawyer

These are the general rules that an administrator must adhere to. (reasonable period of notice for notifying the client) Was the administrator authorized to sell the home, because this sale must take place in cooperation with the heirs.

Questioner

Thank you very much for your response. Do you perhaps have a site or linq for me where I can find this? Yes, he was authorized to do this and all the heirs agreed. He only did this after a year and a half, so he simply neglected it, and fortunately the house was sold within a week. We received an advance to pay the inheritance. The executor has still not paid out what is left of the sale (house sold 31.1.2019). So I understand that this should have happened already. We did receive a message that a small amount will be withheld for the settlement of Essent, but we have not received a settlement.

Lawyer

If you contact me directly I can provide you with further information. Also an explanation of the consequential damage of the late sale of the house.
