Legal Assistance for Certificate Issues

Questioner

I work in Logistics as a forklift and reach truck driver and am required to take a refresher course every 5 years (during working hours, financed by the employer) to have the validity of both certificates extended. Up until now, I always received the extended certificates shortly afterwards. However, now my employer refuses to provide me with the certificates. I could possibly get a copy (after much insistence), but in my opinion I am entitled to the original certificates, because they are personal. Question: who is right? And if the employer is required to provide me with the original certificates but continues to refuse: how can I 'enforce' this? Many thanks in advance. Additional information: the company does not have a collective labor agreement. I have requested my certificates verbally, not (yet) in writing.

Personal certificates must be given to the person. I advise you to consult with your employer again and ask for the certificates to be issued. If he does not want that, you can ask what the reason is. If consultation does not lead to a result, I advise you to submit a written request to the employer for delivery. Please note that this may have consequences for the mutual relationship. Do you feel that the employer 'wants to get rid of' you? Do you have any questions? Please feel free to ask.
