Mortgage change by Advisor Wrong? Free Advice!
Questioner
Change of mortgage due to incorrect advisor. My mortgage needs to be changed because one loan part of the two loan parts is based on a mortgage period of 360 months while this should now be 312 months. This means that I need to make a change to my mortgage: a higher monthly payment and a one-off additional repayment. What are my rights in relation to the advisor and does the desired change offer openings to terminate the mortgage relationship and switch to another mortgagor?Lawyer
I don't think you can take out another mortgage, but I can only judge that after viewing all the documents relating to the mortgage you have taken out. If you are confronted with damages as a result of an error made by your advisor, you can recover these from that advisor. I advise you to consult with him or her in order to arrive at a solution. If a solution is possible after consultation, you can formally raise the issue by submitting a written notice of liability and claiming damages in writing. Do you have any questions?
