I cancelled my accountant. He responded the same day and said: Too bad I won't continue doing the administration, we have to make an appointment to hand over your documents. 4 days later he sends an invoice for 636 euros and says: Too bad you didn't cancel earlier, I have booked the balance and v/w of your company, first you have to pay and then you will receive your documents. Here is my question, do I have to pay the invoice? I had not given an order to start with the annual declaration and we have no contract. Thanks in advanceLawyer
If there is no contract, you will also have to prove what you are stating. If you have not given an order for a tax return, you do not owe the accountant anything in principle. This may be different if he has already incurred reasonable costs in preparing the return. He will then also have to demonstrate this. I advise you to state in writing that you will not pay due to the lack of a basis or agreement. However, if he persists, please contact me directly for further assistance.Lawyer
The appeal to the right of retention must justify the seriousness of the payment arrears. If you get into big trouble because of this, the accountant may not do this. A complaint can then be filed.Questioner
