Assistance with Employment Contract and Employer's Declaration

Questioner

My husband has a permanent contract. We now know that his position will be terminated in the foreseeable future. In that same period, my husband needs an employer's statement for a new house to be built. Unfortunately, we can only apply for the mortgage once the environmental permit has been approved. This means that there is a risk that the position will have officially terminated by then. But in my opinion, that does not mean that the employment contract will terminate immediately. In other words, my husband still has a permanent contract until the contract is terminated. And from that perspective, an employer's statement should still be provided. Is this assumption correct?

Lawyer

In principle this is correct. If the function is to be terminated but the employment contract remains in force, an employer's statement can be requested. Incidentally, the employer is not obliged to provide such a statement. If a statement is provided anyway, the employer must also indicate when the function is to be terminated. If you are unable to reach an agreement (yet), I would be happy to look at your case.
