Legal Question about Savings and Tax Authorities

Questioner

Dear, I have been saving for my 12-year-old daughter for years in 3 different savings accounts in her name. Her mother and I both have parental authority, but we divorced years ago. My daughter has been living with me since then. As parents, we each declare 50% of the child's assets on our income tax return. Now the mother is in trouble and has a large tax debt. My question: Can the tax authorities claim 50% of my daughter's savings to settle her mother's debt, or can the tax authorities not touch that? Kind regards. Bert Suikers

Lawyer

No, the tax authorities (BD) cannot touch that in principle. The mother will have to pay her debt through other means. However, the BD can offset any tax refunds against the debts. Perhaps a payment arrangement can be made with the BD. If a legal dispute arises, please contact me directly for consultation.
