Legal advice for car purchase problems | Legal advice

Questioner

Dear, I am looking for advice on the story below and do not know what my rights are now and what to do. Contact has already been made with the franchise organization. On January 2nd my partner bought a yellow Fiat Punto. 20 minutes after picking it up the car stopped and the cylinder head gasket turned out to be blown. Called ANWB, they couldn't do anything because the car had just been purchased. At the request of the garage, the car was driven back with a blown cylinder head gasket. Cylinder head gasket repaired "free of charge". After that the engine light stayed on. Called, took the car to the garage. Could be the exhaust sensor. Engine light stayed on again. A week later, the battery was broken. Replaced the battery (It can happen! Our costs). Engine light still came on regularly. Then the thermometer indicated that the engine was too hot. Took the car to the garage. According to the owner there was nothing wrong and we could just keep driving, it could be the gauge. Asked several times whether the engine really couldn't have overheated from the blown cylinder head gasket/purchase. No, don't worry, if it didn't bother me, that gauge then I should just keep driving, the engine was fine. Shortly afterwards the car stopped again. Apped and then I got an app back that we should not have continued driving, now the engine was overheated. They picked up the car and after a week I called to ask about the status. The engine was broken because we had continued driving and I had to pay 750 euros, then all other costs were included. For us, the cup was full. We placed our trust in them, despite our doubts about the soundness of the car. My partner (whose name the car is registered in) decided to cancel the purchase based on consumer law (car not good from day 1). Letter put in the mailbox and within an hour the son of the owner was at my office (I work next to the garage), threw the keys on my desk and said: I have put the car in front of the door, see what you do with it. That in front of my colleagues. The car has not been repaired nor have we heard anything about the cancellation of the purchase. All apps can still be read and I still have all phone calls (including the one in which I am assured that the engine is fine and that I can continue driving).

Lawyer

You were allowed to rely on the seller's statements, namely that you were allowed to continue driving. Now that the engine overheated as a result, the costs are for his account. After all, you are entitled to a decent car and from what I read, there were many things wrong with the car. The seller will have to prove that the car had no defects at the time of purchase. It seems that you are not being taken seriously by the seller. A letter from a lawyer may be able to resolve the matter. I can help you with this. If desired, please contact me directly for consultation.
