Changing the intended use of your apartment right

Questioner

Dear, I'd like to buy a space on the ground floor of a building. The property is designated for business in the deed of division, but the municipality has since designated it for residential use. However, it now appears that certain other residents in the homeowners' association (the number is currently unclear) don't want it to be used for residential purposes. It's on a street with residential properties on all sides and no shops or commercial properties. Am I allowed to live here anyway, and what is the procedure for having this included in the deed of division? Thank you very much in advance

Questioner

I would need to look into how the option to change the zoning designation has been amended in the deed of division, but generally, a zoning change for an apartment requires the approval of the general meeting of shareholders. This approval will therefore have to be voted on at a meeting of the homeowners' association (VvE). If permission is not granted, you can request the subdistrict court judge within one month of the decision to annul this (negative) decision and also grant a replacement authorization, which means you are entitled to use the apartment as residential space. If you have any questions or would like legal assistance in this matter, please feel free to contact me, free of charge and without obligation, to discuss what I can do for you and what the costs are.
