Our neighbor removed the fence (our posts and mesh). We've already asked him three times to restore it to its original state. He refuses to replace it. He's now paved the designated plot of land (15m x 0.25cm) and placed his own large posts, topped with a life-size canvas, on our property. He also screwed a door hinge to our fence (without asking). Question: Are we entitled to restore the original situation ourselves? Who will pay for it? How should we go about this?Questioner
If it's a boundary fence, it's a shared property, and both of you, as owners, are responsible for maintaining it and replacing it as needed. Without one of you's permission, the other isn't allowed to remove it or make other decisions on your own! Your neighbor should be made aware of this, with or without legal recourse.Questioner
Thank you so much for your quick response. What's the deal with that "legal stick"? We know what he did isn't allowed, but he's just ignoring us: walking away. That's causing irritation! We want to resolve the situation normally. If he had asked/consulted with us, there wouldn't have been a problem. We wanted to put the posts and mesh back in place ourselves, but then he threatened to take legal action if we came onto his property. But otherwise, we can't get to it!
