Trespassing and Divorce: Your Rights

Questioner

Good day. The situation is as follows. I'm going through a divorce. The divorce settlement will be signed soon. My ex-wife left the house (not voluntarily) but turned out to still have some keys. She used them to enter the house. She then discovered that I was living with a new partner and took photos of them. She wants to use them in a lawsuit. She also viewed, copied, and deleted various files on the computer. The fact is that the house is 50% hers and that the computer was supposed to go to me, but the settlement hasn't been signed yet. The computer also contained all sorts of her documents. Can I now file a complaint for trespassing or computer hacking?

Questioner

Yes, that's possible, because your ex isn't allowed to enter the home without permission. I don't know if that's wise in this situation. The facts she established are actually irrelevant. You're allowed to live together, even if she owns half the property. At most, it might work against you when calculating spousal support.
