Homeowners' Association and Garage Doors: Who Pays for Maintenance?
Questioner
Ask We live in a 42-unit apartment building: 21 three-bedroom apartments, 14 four-bedroom apartments, and 7 five-bedroom apartments, plus 15 garages. The distribution key is 11, 12, and 13/505, respectively, and for the garages, it's 1/505. We're currently facing the following problem: the garage doors need to be painted. Most residents say that painting the garage doors is a private matter and that the garage owners should pay for it themselves. Our deed of division states that the garage owners must contribute 1/505 to the maintenance. According to the deed of division, the garages do not have to contribute to: e. Notwithstanding the provisions of Article 17, sub a and b, the owners will contribute to the costs in proportion as stated in sub e, provided that the owners of the garages will not have to contribute to the maintenance and renewal of 1. and renovation of the stairwells; 2. Maintenance and renewal of the elevators; 3. Maintenance and renewal of the central heating if they do not use it; 4. Cleaning costs of common areas; 5. Periodic cleaning of the glazing of the common area; 6. Replacing fluorescent lighting or other lighting in common areas 7. Maintenance and power consumption of the elevator installation (including inspection costs) 8. Water consumption 9. Common Antenna System (NAS) Maintenance We submitted the question to our administrator and he said the following The deed provides the following information regarding the garages: Article 2a: Doors that require/provide access to the private area are private. A garage door for one garage unit provides access to the private garage unit. So, in my opinion, it's private. As far as I'm concerned, there's no doubt about it. Article 10: Every owner is obligated to properly maintain their private area. This includes paintwork. Article 37: The meeting decides on the paint color of doors facing the hall. This is, of course, outside and not on the hall side, but then it falls under Article 7: "The owners or users may not make any changes to the building that would alter its architectural appearance without the meeting's permission." Therefore, changing the color is only permitted with the approval of the General Meeting. In short: The reason now is the desire to have it painted, but who should pay for it? Owner And can the homeowners' association require maintenance/painting? Yes, according to Article 10. But it must be reasonable. I think she means article 1 of the 1973 division regulations. I disagree, as I believe the front doors and/or garage doors are shared, and painting them would fall under the regular withholding of the homeowners' association. Maybe you can help me find the right answer. kind regards the questioner P.S. I am not a garage owner myselfQuestioner
No, they are private areas. The first article you're referring to states that garage owners are not required to contribute to certain other costs. This applies to situations where one owns a garage but not also an apartment, or separates the maintenance costs. The contribution obligation does apply to shared maintenance that is part of the garage block.Take the next step
