Legal Assistance with Child Support Revision
Questioner
I've been divorced from my ex-wife for over eight years. We both agreed to pay child support. My work conditions made it impossible for me to meet the monthly payments. Her work only improved; she now earns about six or seven times my salary. Therefore, I'd very much like to have the agreement amended, but I don't have the resources to have a lawyer present this to her. What can I do?Questioner
Dear sir, I advise you to try to reach a resolution in a verbal conversation with your ex. You can appeal to the fact that she earns 6-7 times more. If that doesn't work, I can make a recalculation for you at a very reduced rate, which you can then discuss with your ex. Do you have any questions? Please feel free to ask.Questioner
Thank you for this very quick reply, I really appreciate it. I don't talk to my ex anymore, which was her explicit wish. For the past few months, she's only wanted to communicate via email, but she's stopped doing that now. I'd really like to have a recalculation done. Is there a standard rate for that? Then I can explore the options. I've recently started paying €336 per month in child support, but given my income (I'm self-employed, have no fixed income, and am struggling to find work), I'd like to see that reduced to around €200 per month, based on her income. On top of the child support, I also pay separate clothing allowances directly to both children. That amount is €70 per month for the eldest, and €35 per month for the youngest. The visitation arrangements in the agreement are also no longer correct and have been adjusted for a long time, also on her advice. In principle, we now divide our time on a 50/50 basis, although the youngest has now indicated that she prefers to study with her mother for peace and quiet. I certainly understand that. I'll wait for an answer, perhaps we can go into the details at a later stage. Kind regards, Hugo BaudertQuestioner
