On Thursday, July 25, 2019, at 2:43 PM, I filled up with diesel at a gas station on the A3 in Germany. The pump was released just before our turn. A red and white ribbon was removed by an employee. Very soon after refueling we had problems with the car's engine on the A3. Power dropped sharply, a cylinder failed. Top speed was only 40 km/h. After 25 kilometers from the gas station we came to a standstill. We contacted the German roadside assistance directly. They transported the car to the dealer garage. At first it seemed that an injector was defective. Today we learned that all parts that had been in contact with the fuel are defective. The garage is certain that the damage was caused by the fuel. The exact amount of damage is not yet known, but it is certainly thousands of euros. What steps do we need to take to hold the gas station liable for the damage to the car? Because this case concerns a foreign country, we're having difficulty contacting the various authorities.Questioner
Ir/Madam, I advise you to have an expert determine which fluid you used in your tank in Germany and to remove a small sample for analysis. Only then can you determine whether that fluid is the cause of the damage. In the meantime, you can hold the owner of the gas station liable for the damage. Dear, I would ask the gas station if they recognize their liability. If not, I would initiate legal proceedings to have a court-appointed expert conduct an investigation. That will be expensive, but if the station is truly liable, all costs will be reimbursed, and that way, a certain result can be achieved within a short timeframe (for legal proceedings).
