Received a summons? Find out what to do!
Questioner
Good afternoon , I have received a summons from long-serving bailiffs. I have to go to court but want to make a payment arrangement in writing. Do you have a standard letter for this? And can this?? regardsQuestioner
You can try to make an appointment with the bailiff to have him withdraw the summons, but he is not obliged to accept this without some compensation; a summons and writ cost money.Questioner
In addition to my colleague's answer, and if the summons is not withdrawn (and the proceedings are not dismissed): if you are summoned to appear in court, not the subdistrict court, you will need a lawyer to defend yourself. Without a lawyer, the court will assume you did not appear and a default judgment may follow. You can also proceed in court without a lawyer. Please also keep a close eye on the date and time of your summons. You must request an extension for the statement of defense ("statement of defense") in a timely manner or ensure that the statement of defense is received by the court on time. In the subdistrict court, you could also present your defense in person (in court), although this is not customary.Take the next step
