Assistance with Easements and Oral Agreements

We have an easement with a commercial property next to our home (notarial) Now the company no longer uses their strip which ends in our garden. We agreed (verbally) five years ago that we could cover the shared alley and build a garage there. It wasn't a problem at all. Now the building is being sold, and the company no longer knows anything about the verbal agreement (five years later). We have now been summoned to a slum lawsuit, in order to remove it completely, we can derive rights from this verbal agreement.Questioner
