Liability of Minors in Sports Training
Questioner
Hello! We are investigating how we can allow minors to participate in our sport in the same training sessions (and therefore with) adults. We are concerned about liability, but we have also encountered the "Kelderkuik" ruling. If we understand correctly, adults cannot be held liable for any damage to minors (or other adults) during normal playing and training situations. Liability can arise when damage occurs outside of playing and training situations or due to irresponsible actions by the player(s) and/or coaches. We assume that under normal circumstances (coach supervision, normal protection, and normal physical contact during playing and training situations), there can be no question of liability for damage. Is this correct?Questioner
Is this sport suitable and appropriate for practice, and can it be taught in the same way as for adults? You need parental permission. Clubs often try to avoid any form of liability, but forget that a single note and a strong justification are all that's needed to establish liability. It then remains to be seen how insurers will reach an agreement or whether the court will rule. If intent or conscious recklessness bordering on intent can be proven, excluding it is pointless. The standard that applies to games and sports is broader, but also has its limits. Therefore, conditions are necessary, preferably well-designed, but in practice, leave room for interpretation.Take the next step
