Notice of default: What to do if you have legal questions?

Questioner

My company received a notice of default. It was alleged that work had not been carried out properly. However, this wasn't reported to me in any way until the notice of default was issued. There were also supposedly inspections that weren't reported to me either. I've since written two letters to their lawyer, promising to fix any errors and also requesting a counter-assessment. I've asked if I can pass their information on to a structural engineer who will inspect everything on-site. So far, I haven't received a single response. I sent the first letter on August 15, 2019, and the second on September 3, 2019. These people also somehow managed to get my private phone number. What else can I do?

Questioner

Thank you for your question. Since the other party hasn't responded to your notice of default, you can't do anything more than you've already done. You acted correctly. You have the right to inspect the alleged defects (or have them inspected) and you have shown your willingness to repair any defects if necessary. If the other party doesn't respond at all, but does take legal action, it's virtually impossible, because by not giving you the opportunity to take charge of the work and repair the defects, the other party will be in default. If you have any questions or require legal assistance in this matter, please feel free to contact me, free of charge and without obligation, to discuss what I can do for you.

Questioner

Thank you for the quick answer; I thought so, but I wasn't sure. I will wait and see. yours sincerely, Peter
