Riding school liability: can the owner be held liable?

My pony is stabled at a riding school. Here he got his hind leg stuck between/under the stable door when it was closed. Unfortunately, he suffered a fracture and has to go to a clinic to get help. The stable is completely closed off and at first glance there is nothing wrong with the sliding door. Now, after looking very carefully and after various theories (how this is possible since the space between the door and the ground is at most 2 cm), we have found that at the top of the door, one of the two lock nuts on one suspension is missing, which means that the door has a little more play upwards than all the other doors. We have reported this to the riding school owner and so far no steps have been taken to resolve the problem. Now my question is, can I hold the riding school owner liable for this story?
