We have terminated our lease after 17 years. 1. We gave notice on September 30th (because we pay monthly, we legally have a one-month notice period) and are moving on November 15th. So, six weeks after giving notice. My question: can we actually pay half a month's rent in November? 2. We've lived here for 17 years and have always maintained the boiler ourselves. I recently read that this is the landlord's responsibility. Is that correct? Can I deduct that amount from the deposit? 3. The lease agreement is from November 2002. After that date, the landlord is expected to have prepared an initial statement. Our landlord hasn't done so. What is expected of us after 17 years of rent? What can and can't be expected of us (the property wasn't in good condition, even though the landlord claims it was)? 4. The landlord is coming for a pre-inspection and she is also bringing someone along, is that allowed? 5. If we can't reach an agreement, what are the options? You have many questions, and they're justified because the business relationship between tenant and landlord has ended. The latter, in particular, often see reason to add all sorts of extra costs. Since an initial condition is not available, the rental property is deemed to have been delivered in its initial condition, unless proven otherwise. Normal wear and tear and usage marks may not be charged as damage or offset against the deposit. However, you are not allowed to withhold half a month's rent unless the landlord has found a replacement. They shouldn't enrich themselves through your breach of contract. Regarding the boiler: it's normal for the tenant to do minor repairs and maintenance that they can do themselves. Major maintenance on technical systems is the landlord's responsibility.
