Refusing an Inheritance: What You Need to Know

Questioner

Dear Madam / Sir, How do I refuse an inheritance? My sister has COPD. She has exhausted all her treatment options and will therefore die soon. Her husband has lung cancer. He is also expected to die this year. Thanks to the investment mortgage they took out at the time, their house is underwater. Moreover, it has been severely neglected and therefore isn't earning back its cost. I don't know how much debt they are leaving behind. Question 1: What must the two children do to refuse this inheritance? Both recently completed debt restructuring. Question 2: How do I avoid being responsible for that debt myself? Question 3: If a declaration of inability is required for this, what is the upper limit for obtaining such a declaration? Question 4: Is my pension fund BV exempt from this? My pension fund payment is my only income. Kind regards.

The inheritance must be renounced or accepted with benefit of inventory. Your children must also renounce. This can only be done after your death.
