Reporting sick after a settlement agreement?

Questioner

After signing a settlement agreement dated December 19, 2019, in which I agreed to the termination of my employment as of May 1, 2020, I became ill. Can I report my illness to this employer? What are the consequences, and what is the status of the previously concluded pre-employment benefits (VSO)?

You are required to report sick to your employer. You (and your employer) have reintegration obligations. The agreement in the settlement agreement will normally not be affected by the illness (I don't know the contents of this settlement agreement). It is often also agreed that the employee must adhere to the reintegration obligations (due to their own risk-bearing status). If you are still sick on the end date of the employment relationship, your employer will report you sick to the UWV (Employee Insurance Agency), and you will likely be eligible for a sickness benefit (ZW).
