Tips for legal land exchange and cost savings

Questioner

Our neighbors and we swapped a piece of land, without giving each other any money, so it was a real swap. We swapped a section of our driveway, which we had been using for years but fell under their property, and they swapped a section of our alley behind it, which they had been using for years. We've now officially registered this with the Land Registry. If I understand correctly, this doesn't benefit us either if we or our neighbors sell the house, does it? The notary's registration proved to be very expensive. A valuation of both plots of land even had to be drawn up, which also included real estate agent fees. All in all, we came to €1,500. Is there perhaps another solution or do we have to accept this? Please share your opinion. kind regards

Questioner

I already answered this question for you: wasn't the answer clear? It depends on what the parties want: personal exchange (converted into temporary use) or business exchange (which is a permanent, transferable, limited right). In the latter case, one party can force the other to notarize the exchange. This will also result in an adjustment in the land registry. But the parties can also have the transaction removed from the land registry. What exactly is currently recorded in the land registry?

That's right, I was happy about that too, but in your reply, you assumed we exchanged money, which wasn't the case. I replied that way, but didn't get a response. Maybe I did something wrong. I have scanned the documents from the land registry but see no way to include them. We received a letter from the Land Registry with the new drawing of the plots and a letter with the confirmation in text thereof. The neighbors and I are looking for an affordable solution to ensure this split remains permanent. Perhaps you have a tip for us.

That doesn't change the answer. You've both valued the land equally. You might still have a problem with the tax authorities. You can contact me first, and then I can assess the documents free of charge. Perhaps I can help you.
