Notice of termination: Are you entitled?

Questioner

Good morning, Am I still entitled to a notice payment if the employer has already managed to circumvent this in my contract? I wanted to attach the excerpt from my contract, but that is not possible.

Questioner

If your employer doesn't give at least one month's notice of termination, you're entitled to a notice payment. This can't be contracted away. However, some employers do try to include it in their employment contracts. Whether this is permitted is debatable.

Questioner

Thank you very much for your response, but for me the question now is whether I can challenge this.

Questioner

Yes, if your employer violates the law, you have a case. A specialized employment law attorney (member of a specialized association) can assist you. The initial consultation (max. half an hour) is often free, such as at my office.

Questioner

I'm now in two minds. You indicate there's a case, but I'm getting a different response online. See below: Should I include a notice in my employment contract? It's possible to stipulate at the outset that the employment contract will not be extended upon reaching its end date. This also fulfills the notification requirement. However, announcing the non-renewal in advance may not be tactically wise, as it could lead to the employee being less motivated to perform their duties.

See my first answer where I pointed out that possibility. However, the online claim is too assertive that it is possible. I also don't know the source. Not everything online is 100% true.
