VVE Wall Painting: Your Legal Question Answered

Questioner

dear sir or madam, I live in a purchased apartment that's part of a homeowners' association (VvE) with two other apartments. I'd like to paint the walls of my enclosed balcony at the rear white, matching the walls of the adjacent houses (with different VvEs). These walls are currently brick-colored and untreated. The owner of the underlying house has objected and wants to discuss this within the VvE. However, I'm wondering if this is even a matter for the VvE, or if these walls are private. I can't find any specific statement about this in the deed of sale. Am I then legally entitled to paint my walls, aside from the building regulations? thank you in advance

It is possible that external regulations have been set out regarding requirements regarding colour and material and what is and is not allowed on the balconies (hanging out laundry, for example). However, if the homeowners' association allows deviations in several cases, they cannot forbid you to do the same if other owners are allowed to do so.

Questioner

Thank you for your response. The deed of division is modeled after 1973, and no further agreements have been made regarding balconies or anything like that, except for the color of the woodwork. The wall color we would like to use is the same as this color. The other painted balconies belong to other homeowners' associations, so we have given permission for this.

Then you would say that only the municipality's rules regarding aesthetics apply.
