Legal Assistance for Car Purchase Problems
Questioner
Dear Legal Aid Clinic, I recently bought a car from a Peugeot dealer (privately), and I also had a trade-in car (business). The signed contract shows our signatures. Now I'm home and checking the full list of options, and it turns out several are missing, such as active brake assist, and the wheels are 18 inches instead of 19 inches. It also turns out I wasn't told this was a French import. The only information was section 1a, July 1, 2017, but that's the general registration number somewhere in the world. Is there anything legal I can do about this, because it doesn’t make me very happy? Yours sincerely,Questioner
If it was agreed that the currently missing options would be installed on the car, this constitutes a breach of contract. The first step is to notify the seller of the default and, if possible, give them a deadline to comply, i.e., to ensure the missing options are installed. If that proves impossible, you could consider partially terminating the purchase agreement and reclaiming a proportionate portion of the purchase price. The seller may be willing to agree to an amicable settlement in this regard. You are obligated to protest promptly, so ideally, you should not wait too long to take action.Take the next step
