Plumber's Liability: Questions & Advice

I'm a board member of a homeowners' association. We had an annual maintenance contract with a local plumber for the annual servicing of our central heating boilers, all of which are owned by the residents. Due to a serious dispute with one of the residents, we terminated the contract and are looking for a new supplier. A major national installer conducted a baseline assessment and rejected almost all the installations because they did not comply with current regulations. My question is whether we can claim damages from the plumber who never informed us that the situation did not meet the regulations?Questioner
If the inspection falls under the plumber's duties (based on the general terms and conditions) and the contract was commissioned to verify this, you can hold them liable if it turns out there's a rejection.
