Changing Children's Surnames: What to Do?
Questioner
My children, ages 13, 15, and 17, want to change their surnames. Their father refuses permission. We meet the statutory requirements. We've been divorced since 2015, and the children have been living with me full-time since October 2016. This decision was made through a court decision with the Youth Care Agency. What should I do to still be able to help the children fulfill their wishes?Questioner
Dear Madam, If one parent refuses to consent to the filing of the name change request, the other parent (the "interested party") can file a request for substitute consent with the court. The person whose surname the child will receive must also sign the request. Children aged 12 or older must also agree to the name change request. I can represent your interests at a reduced rate.
