Liability in case of bankrupt contractor
Questioner
We bought a bathroom from a bathroom/kitchen retailer. They outsourced the installation and fitting to a contractor. It turns out the shower faucet wasn't installed properly, causing water to seep behind the tiles. As a result, we now have a moisture problem in the wall of the adjacent room. When they held the kitchen supplier liable for the problems, they claimed the contractor was responsible. However, the contractor has since gone bankrupt, leaving the seller with no recourse. However, they hired a contractor to install the bathroom on their behalf. Can we hold the seller liable for the damages incurred?Questioner
You can. The seller is liable, unless otherwise agreed in writing. Now that the contractor is bankrupt, they will have to repair the defect or provide other compensation. I recommend that you first notify them of the default for repairs; if not, you can cancel the purchase and claim damages. If they remain reluctant, please contact me for further assistance.
