Legal advice on returning damaged goods
Questioner
I bought a coat online on October 15th. I received the jacket on Tuesday, October 20th. It fits and is exactly what I want. So I cut out the tags, and four days later, I tried it on and was surprised to see that the center back seam was undone. I reported this that same day via the contact form on their website. I also called the company's mobile number. And I emailed shop@x with this complaint. I did all of this within the 14-day return policy. I haven't heard anything from the company. Now I'm getting a text message from them telling me to take the jacket to a clothing repair shop and have it repaired. I need to send a photo of the receipt for their accountant. But the jacket is new, even though I cut out the tags. Shouldn't they send me a new jacket or give me a refund? Returns must be shipped at your own expense. I received the jacket with a torn center-back seam. Shouldn't I be able to return it free of charge and then receive a different "non-damaged" jacket or a refund? After all, it's not my fault that they deliver a damaged jacket to me. What should I do now? I'd appreciate your feedback on this.Questioner
There's something else going on. You're not invoking your right of withdrawal (no regrets), but you're claiming the purchased item is defective. This constitutes a non-compliant purchase, and the retailer is applying the law correctly: they must compensate you for the damage or repair free of charge.Take the next step
