Have I fulfilled my reporting obligation as a seller and is it legally sufficient to avoid being held liable in the future?
Questioner
I intend to sell my house with roof terrace myself. In principle, an environmental permit has been properly granted for the roof terrace, however, the roof terrace has been made considerably larger than stated/permitted. In order to prevent liability in the future, I want to report this verbally to the buyer and mention this deviation in the NVM questionnaire part B. In the purchase agreement article 21 'Clause enclosed documents' reference is made to this questionnaire. Have I fulfilled my reporting obligation as seller in this way and is it legally sufficient to not be held liable in the future?Lawyer
Yes, because you make it clear that the municipality can possibly submit an enforcement request if it finds out that the owner has not adhered to the specified measurements. Perhaps it can then still be legalized.Take the next step
