Am I obliged to pay for a rental boiler if it is not clearly stated in my rental agreement?

Questioner

Hello, Some time ago I was in discussion with Domesta (housing association) and Energiewacht about a rental contract that I apparently had for a boiler in my old rental home. I lived in this rental property from April 2011 to October 2017. It was not until October 2014 that I started paying for the rental boiler. I don't remember why I only started paying for this then. In my email I can't find any agreements or anything like that or contact about registration. I was always under the impression that it wasn't a rental boiler, but that this was included in the rent. Now the problem; Recently I discovered that I have paid rent every month from October 2017 until a few months ago. I myself believe that this is not possible, because I find it a very strange construction! When contacting Domesta they indicate that they do not have an old agreement from me that contains things, the file is a mess, they literally say on the phone. The supervisor (who was also present at the termination of the rental property at the time) also indicates that he finds it a very strange and old construction! (unfortunately I did not record this conversation. When contacting Energiewacht, they indicate that they are not aware of the fact that I have left the house. Because Domesta does not report this and I have not reported anything myself. I understand this somewhat. Tomorrow I will contact Energiewacht to ask them for a contract or something. Because if one of the parties can show me that there are clear papers in my file, then you will not hear me complain. However, this went very shady! I am curious about your opinion. Perhaps you have encountered such situations before. Thank you in advance, Michel

I would contradict everything: also your obligation to pay the monthly rent boiler because the landlord must explicitly and separately state this on the rental contract. You then have a claim on your landlord for at least 5 years after this discovery.
