Can my employer force me to work in an environment that is not good for me?
Questioner
Hello, I am asking this question for a friend because he cannot speak Dutch well yet. He has a job and now he is on sick leave because he has problems with the dust, he has become really ill and is at home with asthma, now he has such a bad reaction, red and burning eyes and very short of breath, now they want him to come to work 2 hours a day because the company doctor said that he has to consult with the employer to come and work 2 hours a day in a dust-free environment or where there is almost no dust, now he went to the doctor again this morning and he said that he is absolutely not allowed to work in that environment, that it is very bad for his health, but the employer is now being very difficult and wants to deduct those 2 hours every day from his salary and his contract will be terminated on February 28 So my question is can you help him with this pleaseLawyer
If your friend is still experiencing health problems, he can request a second opinion from another company doctor in addition to the advice from the company doctor. This doctor will again assess the incapacity for work. Supported by the statement from the family doctor, it is possible that the other company doctor will come to a different conclusion. If your friend cannot (yet) reach an agreement and a legal dispute arises, he can, if desired, contact me/our network for consultation. The first half hour is free.
