Am I entitled to severance pay?
Questioner
Good morning, I am currently in the procedure for a WIA application. On February 4th I will be on sick leave for 2 years due to a burn-out and personal sad circumstances. If I am, wholly or partially, incapacitated, there will be a proportional dismissal based on the percentage of incapacity. Am I then also entitled to severance pay? I have been working for the organization for almost 22 years and have never had to deal with benefits..... Do I need to take any action on this? Thank you in advance for your answer. Yours sincerely, Grace de Clonie Mac LennanLawyer
After 2 years of illness, the employer may/must dismiss you. You are then entitled to a full or partial transition payment (TV). This is determined by law in a ruling of the Supreme Court. The employer is compensated for this If the employer is being difficult, I advise you to contact a specialized employment law attorney (member of a specialist association).Take the next step
