Can my employer require me to have a negative PCR test?

Questioner

Hi, at the end of October I came home with a fever, I had a fever for 2 days, then wanted to go back to work, but this was refused because I was suffering from cold symptoms, I suffer from this quite chronically at this time of year, and I also reported this to my employer. Then I had to stay home for a week and be symptom-free for 24 hours. (The thing is, I don't want to take a PCR test, for personal reasons). Now my employer demands a negative PCR test from me before I can return to work, and yesterday I received a registered letter stating that they want to suspend my salary as of February 1. My question is, can they legally do this? I am now going to send an email to my employer stating that I am in perfect health and would like to return to work, but I expect that they will still require the PCR test. I would like advice on the next steps and whether they have legal grounds to stop paying my wages. Kind regards

Your employer is not allowed to check you for corona himself. However, your employer may ask the company doctor to do this. You can find all kinds of information about this on the website www.autoriteitspersoonsgegevens.nl. If your employer nevertheless suspends your salary, I advise you to hire a lawyer to defend yourself against this. If you wish, you can contact us.
