Garden company fails to perform

In the fall, we had a garden company (JRG Zahn, Burg. Coonenlaan 46, 6373 TN Landgraaf) place a retaining wall (approximately 19 meters in total and 1 meter high) at the back of our garden, with a fence of 180 cm. high. This appears to have so many construction errors that it is now even in danger of falling over and could therefore be dangerous to the environment. He has been promising to repair this for quite some time, but he does not keep his promises. Moreover, the retaining wall cannot be repaired but, according to other people we have contacted, must be completely demolished and replaced by a proper retaining wall. You must hold the contractor liable for breach of contract, preferably by letter, and give him a final chance to repair the damage, but he must also bear the costs of repairing the retaining wall. If he fails to respond or act within the permitted time, he will be in default and someone else must be called in at his expense.
