What are my rights in the event of dismissal with a fixed-term contract of 1 year?
Questioner
Just after my probationary period expired, I was informed that I would be exempted from work and that my employer and I would part ways. It was stated verbally (4 February 2021) that we wanted to part ways in an amicable manner, whereby my employer wanted to give me time to find another job. The settlement agreement (received on 12 February 2021) states that I am not to blame and that I have done nothing wrong in my work. They propose to continue paying two months' salary (until 26 March 2021). My question is what are my rights in this situation? This concerns an employment contract for one year (employment date January 4, 2021).Lawyer
The question is whether there is an interim termination clause in the contract? If so, then it can be terminated prematurely. If not, then the employment contract will continue until the end date. In that case, it is not wise to accept a VSO. I advise you to contact a specialized labor law attorney (member of a specialized association) as soon as possible, e.g. me. Often the first consultation (max. half an hour) is free, such as at my office.Take the next step
