Change exit
Questioner
We have applied for an environmental permit to change our exit. The existing exit is 3 meters wide and we want to increase it to 8 meters. The municipality currently has no policy rule for the maximum width of an entrance/exit. The starting point is that it is not may be at the expense of a public parking space/public green area (neither of which is the case). Now the traffic department has measured and indicated the following: - The total distance from the existing driveway to the corner is 15.5 m1 - Since parking is not allowed within 5 m1 from the corner, 10.5 m1 remains. - This is, calculated with the standard of 6m1 for longitudinal parking, sufficient for 1 vehicle. If permission is granted for a widening of 1.5 m1, 9.0 m1 remains. Still enough for 1 parking space. I do not understand where the official gets a widening of 1.5 meters from. I have adjusted the permit application for widening the exit by 4.5 meters. That leaves 11 meters (the first 5 meters may not be parked and then 6 meters for parallel parking). When asked, the municipality indicates that they use a maximum of 4.5 meters because this is a common size in the country. I see no legal basis for this and am curious about what my options are. The municipality is now appealing to a general unwritten rule of policy and must motivate this further. Ask for the written rule or where the municipality got its knowledge from now that you are still in the application phase.Questioner
Hello Monique, Thank you for your response. There is no written rule. Can the municipality appeal to an unwritten rule? I am also curious whether the municipality can refuse my application. If so, does it make sense to appeal? Greetings EdwinTake the next step
