I am held liable for an unlawful act under article 6:162 BW, taking various shared items
Questioner
Dear Sir/Madam I recently broke up with my ex. We didn't have a cohabitation contract or anything. I left while he was working from home and took my things with me. My motivation for this is that my ex can give an unexpected reaction and can come out aggressive and intimidating. And can become unpredictably angry and did not dare to enter into this confrontation for my own safety. Now we also had a cat together. In the past I was the person who really wanted a cat and made moves to adopt a cat to keep me company when I was at home without work due to the corona crisis. We purchased this cat together, including some supplies. I took this pet with me when I left, along with the supplies that came with it, and then I temporarily moved in with a friend in Amsterdam, where I am currently staying My ex lives in Schiedam. Now the following has happened: While moving these things, a friend and I locked ourselves out of the house and had to call a locksmith. I paid these costs myself. After this, on Friday 12-2-2021 I received a WhatsApp message, an email and a few days later a registered letter. Unfortunately I cannot attach this letter to this application, but I would like to send it to you so that it can be properly reviewed. To briefly describe this letter, I am held liable for an unlawful act under article 6:162 BW for taking various shared belongings, the pet and the gifts he has given me recently. Later in the letter he asks me to return the pet. Now this is not an option for me because it has always been my idea to get a pet. And she has been my companion. If I did not take action on this further steps would be taken. Expect the response within 7-10 days. Now this letter is without a date in the document, it is not signed and there is no logo of a lawyer or anything like that anywhere in the document. I suspect my ex gathered information on the internet to draw this up. I would like to ask for advice on how to resolve this. GreetingsLawyer
In some cases there is a right, like that of that pet, a district judge will have to give a decision for division. But gifts have been made. Show me that letter.Take the next step
