How do I get paid for my hours worked as a self-employed person?
Questioner
Dear, As of October 28, 2020, I started working as a self-employed person for a car company. We agreed on an hourly rate in advance. I completed October and November by sending an invoice and these have been paid. In December I worked 26.5 hours. I stated by telephone that I would finish my work for that day properly and leave it at that. The company refuses to pay the invoice for the hours worked in December. He is suddenly not satisfied with my work and even threatens to claim damages to his company (by me) from me due to serious errors. Very strange because during my work I have received compliments about my work. What can I do? And how strong am I? I look forward to hearing from you.Lawyer
In itself it is nice that the company complains about the work, at least if it is in writing. Then it is established (depending on the wording) that work has been done. And if work has been done, then there is a payment obligation. How strong the case is I would have to determine based on the file. That is not to make it difficult, but in NL all factual circumstances count, that makes each case unique. For the collection it is in any case important, and you can do that yourself, that there is notice of default, and two reminders. You can also, depending on the contract concluded, state a penalty clause and statutory interest. If payment is not made, you can go to the subdistrict court for this amount. There is a procedure that you can conduct yourself. If you consider yourself less suitable, you can contact me or one of my colleagues.Take the next step
